These Terms of Service ("Terms") govern your use of genxsports.net (the "Site") and the charter and vehicle rental services offered by Gen X Sports ("Gen X Sports," "we," "us," or "our"). By accessing the Site or booking our services, you agree to these Terms. If you do not agree, please do not use the Site or our services.

Our Services

Gen X Sports provides boat charters, custom charters, and vehicle rentals on Guam and surrounding waters. All services are offered subject to availability, weather, sea conditions, and our discretion. Specific details, rates, and requirements for each booking are confirmed directly with you at the time of reservation.

Bookings & Payments

A reservation is confirmed only when we accept it. Rates, deposits, payment methods, and any applicable taxes or fees are provided at the time of booking. You agree to provide accurate information and to pay all amounts due under your confirmed reservation.

Cancellations, Weather & Changes

We may delay, reschedule, shorten, or cancel any charter or rental when, in our judgment, weather, sea conditions, mechanical issues, or safety concerns require it. In such cases we will work with you to reschedule or arrange a refund consistent with the cancellation terms provided at booking. Cancellation and rescheduling policies that apply to your reservation are provided to you before payment.

Assumption of Risk & Safety

Boating, diving, fishing, snorkeling, water activities, and vehicle operation involve inherent risks, including risk of injury. You participate voluntarily and assume those risks. You agree to follow all instructions from our captain, crew, and staff, to use provided safety equipment, and to conduct yourself responsibly at all times. We may refuse or end service to anyone who behaves unsafely or is impaired.

Vehicle Rentals

Renters must hold a valid driver's license, meet minimum age requirements, and comply with all applicable laws. You are responsible for operating the vehicle safely and lawfully, and for returning it in the condition received, subject to normal use. Fuel, insurance, deposits, mileage, damage, and late-return terms are set out in the rental agreement you sign at pickup, which forms part of these Terms.

Eligibility & Conduct

You must be of legal age to enter a binding contract to book our services. You agree not to use our services for any unlawful purpose, and not to operate any boat or vehicle while impaired by alcohol or drugs.

Intellectual Property

All content on the Site, including text, graphics, logos, and images, is owned by or licensed to Gen X Sports and is protected by applicable law. You may not copy, reproduce, or use it without our written permission.

Disclaimers

The Site and our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.

Limitation of Liability

To the fullest extent permitted by law, Gen X Sports and its owners, employees, and crew will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our services. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold harmless Gen X Sports and its owners, employees, and crew from any claims, losses, or expenses arising from your use of our services or your breach of these Terms.

Governing Law

These Terms are governed by the laws of the Territory of Guam, without regard to its conflict-of-law rules. Any dispute relating to these Terms or our services will be subject to the jurisdiction of the courts located in Guam.
